If you have recently received the “Notice of Default” from your lender, it can make your life turn upside down. Your family and you may be engulfed with a high deal of stress and frustrating.

In Massachusetts, when a homeowner has not made his mortgage payments for 3 months, the lender will send them the Notice of Default. That means the lender is intending to foreclose on the property. After receiving the notice, the homeowner is given 90 days to bring the loan current.

Under Massachusetts law, your lender will then file a complaint with the Massachusetts Land Court, seeking a judicial determination that you are not currently in active military service. If you are serving in active military service, you are afforded extra protections under the Servicemembers Civil Relief Act. Massachusetts is a “non-judicial” foreclosure state, and therefore this action does not stop the foreclosure from moving forward.

The prospect of losing the house where you and your family have been living for the past few years can be downright frustrating and gut wrenching. This is your home, your base, and now its going to be taken away from you. That’s just not fair.

I Went Through the Terrible Experience of Foreclosure Myself

I know this is a scary and stressful time for you and your family. I know the feeling as I myself was a victim of foreclosure.

You see, a number of years ago, my wife and I bought and ran a rental property in Roxbury, MA. The first few years went pretty smoothly, but in 2012 we got into a dry spell. Rents were not coming in as before, which made us unable to make the mortgage payments to our lender.

They contacted us by phone and mail but we didn’t know how to respond. We just hoped things would get better for us. But things didn’t get better. Then we received the letter of default with the auction date. We panicked and called the lender to see if they would give us some time to catch up with the back payments.

But we couldn’t come up with the back payments. We can barely make the monthly payments, now we had to pay several months of mortgage plus fees and penalties. The lender went ahead to foreclose on our property.

That rental property was the sole source of income at that time. Losing it was a devastating blow on us. All the savings and hard earned money that we put in the property was now gone plus no more incoming income from the property.

There was still more bad news to come. The foreclosure remark put on my credit report dropped my credit score down by 200 points. I was shocked to learn about that, as I had no idea about the impact of foreclosure on my credit score.

Even worse, I also found out that the foreclosure remark would remain in my credit report for 7 years in Massachusetts. All through that time, I was not able to borrow any money as nobody wanted to touch us.

In addition, the lender threaten to come after me for the delinquent payment. It seems the lender was not able to recoup the amount of loan was that given to me. He wanted to get the delinquent amount by garnishing my wages, taking it out of my bank account, or take my car.

That was a terrible nightmare that I went through. So many sleepless nights and high stress. However,  I also learnt many lessons from it. and I can help you to know the options you have.

The experience of going through foreclosure was so bitter, mainly because I didn’t know anything about the process of foreclosure and didn’t know what I should do and didn’t know what my options are.
